Welcome to Talamo, a comprehensive automated dyslexia assessment tool designed to assist schools in identifying students at risk of dyslexia. These Terms and Conditions govern your use of Talamo’s services, including our desktop web application, dashboard, and related offerings (collectively, the "Service"). By accessing or using the Service, you agree to comply with and be bound by these Terms and Conditions. If you do not agree with these Terms and Conditions, you must not use the Service.
1. Acceptable Use
1.1 Intended Purpose:
The Service is intended to be used as a risk assessment tool to help educators identify indicators related to dyslexia in students. It is important to note that this tool is not a diagnostic instrument and should not be used as a substitute for professional diagnosis or intervention.
1.2 Unacceptable Use:
Users must not engage in any activities that could compromise the integrity or security of the Service. Unacceptable uses include, but are not limited to, the following:
Cheating or manipulation of assessment results.
Hacking, attempting to gain unauthorised access, or bypassing security measures.
Data scraping or harvesting of information from the Service.
Engaging in any form of intellectual property theft or infringement.
Misusing the Service in any manner that violates applicable laws or regulations.
2. Registration and Accounts
2.1 Account Responsibility:
Schools and their representatives are responsible for ensuring that account credentials are kept secure. Talamo is not liable for any unauthorised access to accounts resulting from negligence or failure to safeguard account information.
2.2 Account Creation:
To use the Service, schools must register for an account and provide accurate, complete, and current information. Accounts should only be accessed by authorised personnel within the school.
2.3 Account Use:
Accounts are provided for the school’s internal use only. Schools are responsible for all activities that occur under their accounts and must notify Talamo immediately of any breach of security or unauthorised use.
3. Data Privacy and Anonymised Datasets
3.1 Data Usage:
Talamo is committed to protecting the privacy of its users. Personal data collected through the Service will be used strictly in accordance with our Privacy Policy, which is incorporated by reference into these Terms and Conditions.
3.2 Anonymised Data:
To improve the accuracy and effectiveness of our assessment models, Talamo reserves the right to use anonymised datasets derived from the assessments conducted through the Service. These datasets will be stripped of any personal identifiers and used solely for research and development purposes. Under no circumstances will personal data be sold or shared with third parties without explicit consent.
4. Liability Limitation
4.1 "As Is" Provision:
The Service is provided on an "as is" basis. While Talamo strives to ensure the accuracy and reliability of its assessments, it makes no warranties or guarantees regarding the outcomes of the assessments.
4.2 Limitation of Liability:
Talamo shall not be held liable for any damages, direct or indirect, resulting from the use or inability to use the Service. This includes, but is not limited to, damages arising from inaccurate or inconclusive assessments. Users are encouraged to seek professional advice for diagnosis and intervention where necessary.
5. Intellectual Property
5.1 Ownership:
Talamo, along with its licensors, owns all intellectual property rights related to the Service, including but not limited to software, content, and trademarks.
5.2 Restrictions:
Users may not copy, distribute, modify, or create derivative works from the materials available through the Service, except as expressly permitted by these Terms and Conditions or with Talamo’s prior written consent.
6. Payment and Refunds
6.1 Payment Terms:
Schools are required to adhere to the payment terms agreed upon at the time of subscription to the Service. Failure to make timely payments may result in suspension or termination of access to the Service.
6.2 Refunds:
If the Service delivers incorrect or inconclusive results, schools may be eligible for a refund at the sole discretion of Talamo. Refunds will be considered on a case-by-case basis and are not guaranteed.
7. Termination Policy
7.1 Termination by Talamo:
Talamo reserves the right to terminate or suspend access to the Service for any school that violates these Terms and Conditions or engages in activities deemed harmful to the Service or its users.
7.2 Data Retention:
Following termination or cessation of use, Talamo will retain account data for a period of 6 months. After this period, all data will be permanently deleted unless a deletion request is submitted by the school prior to the end of the retention period.
8. Dispute Resolution
8.1 Arbitration:
All disputes arising out of or in connection with these Terms and Conditions shall be resolved through arbitration under the laws of the United Kingdom. The arbitration will be conducted in accordance with the Arbitration Act 1996 (as amended) or any statutory modification or re-enactment thereof.
8.2 Jurisdiction:
By using the Service, schools agree that any legal actions or proceedings arising from these Terms and Conditions shall be brought exclusively in the courts of the United Kingdom.
9. Modifications to Terms and Conditions
9.1 Right to Modify:
Talamo reserves the right to amend or modify these Terms and Conditions at any time. Changes will be communicated to schools via email and through a prominent notice on the Service. Continued use of the Service after changes have been communicated constitutes acceptance of the revised Terms and Conditions.
10. Governing Law
These Terms and Conditions, and any disputes arising out of or in connection with them, shall be governed by and construed in accordance with the laws of the United Kingdom.
